83 La Cour a ainsi itérativement jugé que, compte tenu du caractère scientifique de l’inventaire ZICO et de l’absence de tout élément de preuve scientifique produit par un État membre tendant à démontrer qu’il pouvait être satisfait aux obligations découlant de l’article 4, paragraphe 1, de la directive « oiseaux » en classant en tant que ZPS des sites couvrant une superficie totale inférieure à celle résultant dudit inventaire, celui-ci pouvait être utilisé comme élément de référence permettant d’apprécier si un État membre avait classé un nombre et une superficie suffisants de territoires en tant que ZPS au sens de cet article 4, paragraphe 1 (voir, en ce sens, arrêts du 20 mars 2003, Commission/Italie, C‐378/01, EU:C:2003:176, point 18, et du 13 décembre 2007, Commission/Irlande, C‐418/04, EU:C:2007:780, point 52).
