1. If the amount cannot be fully off-set against those aid payments, the outstanding balance shall be cancelled.

Si cette somme ne peut être entièrement prélevée sur lesdits paiements, le solde est annulé.

2. 37 With regard to the origins of Article 11(3)(e) of Regulation No 883/2004, which are set against a background of modernisation and simplification of the rules contained in Regulation No 1408/71, it should be pointed out, as the Advocate General also stated in point 49 of his Opinion, that that provision replaced Article 13(2)(f) of Regulation No 1408/71, which provided that ‘a person to whom the legislation of a Member State ceases to be applicable, without the legislation of another Member State becoming applicable to him in accordance with one of the rules laid down in the aforegoing subparagraphs or in accordance with one of the exceptions or special provisions laid down in Articles 14 to 17, shall be subject to the legislation of the Member State in whose territory he resides’.

37 En ce qui concerne la genèse de l’article 11, paragraphe 3, sous e), du règlement no 883/2004, qui s’inscrit dans un contexte de modernisation et de simplification des règles contenues dans le règlement no 1408/71, il convient de relever, ainsi que l’a également exposé M. l’avocat général au point 49 de ses conclusions, que cette disposition a remplacé l’article 13, paragraphe 2, sous f), du règlement no 1408/71, qui prévoyait que « la personne à laquelle la législation d’un État membre cesse d’être applicable, sans que la législation d’un autre État membre lui devienne applicable en conformité avec l’une des règles énoncées aux alinéas précédents ou avec l’une des exceptions ou règles particulières visées aux articles 14 à 17, est soumise à la législation de l’État membre sur le territoire duquel elle réside ».
