2. The academic Thomas Alured Faunce has argued the World Trade Organization non-violation nullification of benefits claims, particularly when inserted in bilateral trade agreements, can facilitate intense lobbying by industry which can result in effective regulatory capture of large areas of governmental policy.

3. The Understanding is intended to amicably settle the swordfish fishery disputes [1] currently existing between Chile and the European Community (now succeeded by the European Union (EU) in the International Tribunal for the Law of the Sea ("ITLOS") and in the World Trade Organization ("WTO").

Mit der Vereinbarung sollen die Schwertfischfang-Streitigkeiten [1], die derzeit zwischen Chile und der Europäischen Gemeinschaft (bzw. der Europäischen Union (EU) als deren Rechtsnachfolgerin) beim Internationalen Seegerichtshof ("ITLOS") und bei der Welthandelsorganisation ("WTO") anhängig sind, friedlich beigelegt werden.
