1. The Kingdom of Denmark can legitimately access only those profits originating from the time before the sale.

Berechtigterweise kann das Königreich Dänemark nur auf solche Gewinne Zugriff nehmen, deren Entstehung zum Zeitpunkt der Veräußerung bereits angelegt ist.

2. However, one may legitimately criticise its failure to adduce sufficient evidence or prove that the Luxembourg authorities could not perform their monitoring tasks without the involvement of an ad hoc agent resident in Luxembourg.

Andererseits ist ihr vorzuhalten, nicht hinreichend dargelegt bzw. bewiesen zu haben, dass die luxemburgischen Behörden ohne die Beteiligung eines in Luxemburg ansässigen Ad-hoc-Vertreters ihre Überwachungsaufgabe nicht erfüllen könnten.

3. It cannot therefore legitimately be said that a condition for the purchase of the carrier medium is that the purchaser must accept and pay for the right to use the software, as if it were an ancillary item.

Er durfte davon ausgehen, daß das Gastland eine ausreichende Tilgungsdauer zugrunde legen würde und daß die Höhe der Miete angemessen bleiben und dem entsprechen würde, was ein Gemeinschaftsorgan von einem Gastland erwarten kann, das bestrebt ist, eine Politik in bezug auf den Sitz der Organe zu verfolgen.

5. Neither did they contravene the principle of the protection of legitimate expectations, since traders could not legitimately expect that an existing situation which was capable of being altered by decisions taken by the Community institutions would be maintained, particularly in view of the fact that, shortly before the adoption of that regulation, the Commission had established a system of import licences prompted by unfavourable market developments.

Die Schutzmaßnahmen verstossen auch nicht gegen den Grundsatz des Vertrauensschutzes, da die Wirtschaftsteilnehmer von Rechts wegen nicht auf die Beibehaltung einer bestehenden Situation vertrauen konnten, die durch Entscheidungen der Gemeinschaftsorgane verändert werden konnte, zumal die Kommission kurze Zeit vor Erlaß der genannten Verordnung ein Einfuhrlizenzsystem eingeführt hatte, das durch die ungünstige Marktentwicklung gerechtfertigt war.
