Da ich, was die Zulässigkeitsfragen betrifft, keinen wesentlichen Unterschied zwischen diesen früheren Fällen und der vorliegenden Rechtssache sehe, verweise ich allgemein auf meine Schlussanträge in der Rechtssache UCDV sowie auf die dortigen Rechtsprechungsnachweise ( insbesondere die Urteile in den Rechtssachen International Fruit und CAM ( 4 )).

73. In a blog post titled “Siloviki Run Wild” [en], Radio Free Europe Radio Liberty's Brian Whitmore cited an alarming (or alarmist, depending on one's view) editorial [ru] in Vedomosti that identified the Bastrykin scandal as evidence that Putin has given the siloviki (the security forces in the government) a ‘blank check’ to fight the President's enemies.

In einem Blogeintrag mit dem Titel “Siloviki Run Wild” [en] [Siloviki auf freiem Fuß] zitierte Brian Whitmore von Radio Free Europe / Radio Liberty einen besorgniserregenden (oder, je nach Standpunkt, auch Panik verbreitenden) Leitartikel [ru] in Vedomosti. In diesem Artikel wurde der Skandal um Bastrykin als ein Zeichen dafür gesehen, dass Putin den siloviki (den Sicherheitskräften der Regierung) eine “Freikarte” gegeben hat, um die Feinde des Präsidenten zu bekämpfen.

74. He was active in the definition of the ALGOL programming language and cited by Tony Hoare as one of the people who taught him ALGOL 60 and hence facilitated his expression of powerful recursive algorithms: "Around Easter 1961, a course on ALGOL 60 was offered in Brighton, England, with Peter Naur, Edsger W. Dijkstra, and Peter Landin as tutors. ...

Tony Hoare bezeichnet ihn als einen der Menschen, die ihm Algol 60 beibrachten und ihm so die Formulierung mächtiger rekursiver Algorithmen erlaubten: „Gegen Ostern 1961 wurde in Brighton, England ein ALGOL 60-Kurs mit Peter Naur, Edsger W. Dijkstra, und Peter Landin als Referenten veranstaltet.

75. Lastly, contrary to what the applicants claim, the fact that the first applicant did not ask a question in that regard or accept the statement in question does not show that there was no agreement or concerted practice, inasmuch as that does not constitute manifest opposition for the purposes of the case-law cited in paragraph 176 above.

Schließlich ist entgegen der Auffassung der Klägerinnen auch die Tatsache, dass die Klägerin zu 1) weder zu diesem Punkt eine Frage gestellt noch den fraglichen Hinweis akzeptiert hat, nicht geeignet, das Nichtvorliegen einer Vereinbarung oder abgestimmten Verhaltensweise darzutun, denn dies stellt keine offene Ablehnung im Sinne der in Randnr. 176 des vorliegenden Urteils angeführten Rechtsprechung dar.

77. 68 Finally, as regards OHIM’s allegedly divergent practice in decisions, it must be recalled that the legality of the Boards of Appeals’ decisions must be assessed purely by reference to Regulation No 40/94, as interpreted by the Community judicature, and not on the basis of OHIM’s practice in earlier decisions (see CHUFAFIT, paragraph 57 and the case-law cited).

78. 52 In any event, the force of res judicata extends only to the grounds of a judgment which constitute the necessary support of its operative part and are, therefore, inseparable from it (judgment of 15 November 2012, Al-Aqsa v Council and Netherlands v Al-Aqsa, C‐539/10 P and C‐550/10 P, EU:C:2012:711, paragraph 49 and the case-law cited).

Thirdly, the applicants point out that it follows from the order in Jones and Others v Council and Commission, cited above, and in particular paragraph 52 thereof, that in the event that the provisions of Council Regulation (EEC) No 2187/93 at issue in the main proceedings were to be adjudged unlawful acceptance of the offer of compensation contained in that regulation would entail no adverse consequences for them.

Drittens ergebe sich aus dem genannten Beschluß Jones u. a. /Rat und Kommission, insbesondere aus dessen Randnummer 52, daß den Klägern für den Fall, daß die in den Verfahren zur Hauptsache angefochtenen Vorschriften der Verordnung Nr. 2187/93 für rechtswidrig erklärt würden, kein Schaden aus der zwischenzeitlichen Annahme des in dieser Verordnung enthaltenen Entschädigungsangebots entstehe.
