1. A European Commission report on the state of the market published in 2014 asserts that, all in all, wages, absolute levels of labour costs and other remuneration elements are converging across the EU (13).

Laut einem 2014 veröffentlichten Bericht der Europäischen Kommission über den Stand des Kraftverkehrsmarkts herrscht alles in allem eine Konvergenz zwischen den Löhnen, den Arbeitskosten in absoluten Zahlen und sonstigen Vergütungselementen in der EU insgesamt (13).

María Isabel Gea behauptet sogar in ihrem Werk Curiosidades y Anécdotas de Madrid: „Die Stadt Madrid sollte stolz darauf sein, als einzige Stadt der Welt sogar dem Teufel ein Denkmal gesetzt zu haben.“

In those circumstances, given the link between the decision to suspend the exemption and the text of Regulation No 539/2001 created by the footnote, it does not seems possible to me to affirm, as the Commission asserts, that the alteration made to Annex II to the regulation by the insertion of the footnote does not affect legislative elements of the regulation.

Unter diesen Umständen erscheint es mir angesichts der Funktion der Verbindung zwischen der Aussetzungsentscheidung und dem Text der Verordnung Nr. 539/2001, den die Fußnote herstellt, nicht zulässig, zu behaupten, wie dies von der Kommission getan wird, dass die Änderung von Anhang II der Verordnung, zu der es durch das Hinzufügen dieser Fußnote kommt, keine Auswirkungen auf ihre normativen Bestandteile hat.

4. 20. Stresses that the above Commission communication emphasises grubbing-up as a measure to reduce production and the workforce in the sector instead of promoting production control through measures to regulate supply and demand; considers that the consequence of this policy will be that the desired strengthening of the competitiveness of the wine-growing sector will not be achieved; asserts that enhanced subsidiarity may not be used as an alibi for reckless deregulation which will lead to unfair competition even within the borders of the EU;

20. betont, dass Rodungen in der oben genannten Mitteilung der Kommission vor allem als Maßnahme zur Senkung der Produktion und zum Abbau der in diesem Sektor beschäftigten Arbeitskräfte erwähnt werden, statt dass die Kontrolle der Produktion durch die Regulierung von Angebot und Nachfrage gefördert wird; ist der Auffassung, dass es im Ergebnis dieser Politik nicht möglich sein wird, die erwartete Stärkung der Wettbewerbsfähigkeit des Weinsektors zu erzielen; betont, dass die verstärkte Subsidiarität keinen Vorwand für eine blinde Deregulierung darstellen darf, die zu unlauterem Wettbewerb sogar innerhalb der Grenzen der Europäischen Union führt;
