It could be interesting to develop indicators to assess not only access to medical and health services but also a person's awareness and inclination to keep in good health and to follow the basic rules of preventative medicine (gynaecological and dental check-ups, eye tests etc.), whilst taking into account the subjective differences between people living in poverty and people suffering from acute social exclusion, such as those with no fixed abode.

Hierbei wäre den subjektiven Unterschieden Rechnung zu tragen, die zwischen den in Armut lebenden Menschen und den sozial stark ausgegrenzten Personen, wie z. B. den Obdachlosen, bestehen.

23. It is that line of reasoning which led the Court to rule that ‘Article 48 of the Treaty must be interpreted as precluding a provision in the legislation of a Member State on direct taxation under which the benefit of procedures such as annual adjustment of retentions at source in respect of wages tax and the assessment by the administration of the tax payable on remuneration from employment is available only to residents, thereby excluding natural persons who have no permanent residence or usual abode on its territory but receive income there from employment’. Diese Erwägungen haben den Gerichtshof zu der Feststellung veranlasst, dass „Artikel 48 des Vertrages so auszulegen ist, dass er Rechtsvorschriften eines Mitgliedstaats im Bereich der direkten Steuern entgegensteht, die Verfahren wie den Lohnsteuer-Jahresausgleich und die Einkommensteuerveranlagung durch die Verwaltung nur für Gebietsansässige vorsehen und natürliche Personen, die im Hoheitsgebiet dieses Mitgliedstaats weder einen Wohnsitz noch ihren gewöhnlichen Aufenthalt haben, dort jedoch Einkünfte aus nichtselbständiger Arbeit erzielen, davon ausschließen“(30).
