गोलकनाथ के मामले में उच्चतम न्यायालय ने 6 : 5 के बहुमत द्वारा अपने पूर्ववर्ती निर्णयों को उलट दिया और कहा कि संविधान में प्रतिष्ठित मूल अधिकार अपरिवर्तनीय हैं , अनुच्छेद 368 में केवल संशोधन - प्रक्रिया का उपबंध है और उसमें संसद को संविधान - संशोधन की कोई मूल शक्ति या उसकी विधायी शक्ति से अलग थलग या अलग पहचान वाली कोई संविधायी शक्ति प्रदान नहीं की गई है , संविधान - संशोधन अधिनियम भी अनुच्छेद 13 के अर्थांतर्गत विधि है , अत : अनुच्छेद 368 के अधीन पारित संविधान - संशोधन अधिनियम के द्वारा भी संसद न तो मूल अधिकारों को छीन सकती है और न ही उन्हें कम कर सकती है .
