1. “(iv) Any participation as the perpetrator, co-perpetrator, instigator or inciter, accomplice or abettor in the commission or attempted commission of, or conspiracy or plot to commit, any of the acts referred to above;”

2. A person who is not the perpetrator of an offence, as specifically referred to in the relevant article of the special section of the Criminal Code, but who has participated in the commission of the offence referred to in such article, incurs criminal liability for the offence as an organizer, instigator or abetter.

Une personne qui n’appartient pas à la catégorie d’auteurs expressément mentionnée comme sujet de l’infraction dans l’article correspondant de la Partie spéciale du Code pénal et qui a participé à la commission de l’infraction visée dans cet article encourt des poursuites pénales en tant qu’organisateur, instigateur ou complice par aide ou assistance.

3. Each State Party shall adopt such legislative and other measures as may be necessary to establish as criminal offences participation as the perpetrator, co-perpetrator, instigator, accomplice, abettor or in any other capacity in the commission, attempted commission, association with or conspiracy to commit any of the acts referred to in paragraph 1 of this article, as well as conduct by any person who, with knowledge of the aim of an act of corruption, takes an active part in organizing, managing, aiding, abetting, facilitating, authorizing or counselling such acts.

The norms of the Part # of the new Criminal Code and particularly Article # also establish criminal liability for the accessories to a crime: an organizer (a person who organized or led the perpetration of felony as well as established or led a gang or criminal association), an instigator (a person who incited another person to perpetrate a felony by persuasion, financial incentive, threat or otherwise) and an abettor (a person who assisted by advice, instruction, offering an information, resources or tools, eliminating obstacles, had previously promised to conceal the offender, means or tools, traces of felony, to conceal, purchase or vend the items obtained through felony

8.
