31. A production unit, that is to say an industrial plant which functions independently and without any link with any other unit, whose sole activity consists in refining raw sugar and syrups extracted from cane, therefore constitutes a refinery within the meaning of the aforementioned provision, and that definition does not cover a refining unit forming part of an industrial complex which also includes a first-stage unit for the extraction of sugar-bearing liquids obtained from beet.

Daher ist eine Raffinerie im Sinne dieser Vorschrift eine technische Einheit, also ein Betrieb, der selbständig und ohne Verbindung mit einer anderen Einheit arbeitet und ausschließlich Rohrrohzucker und Sirup aus Zuckerrohr raffiniert. Eine Raffinerieeinheit, die Teil eines Anlagenkomplexes mit einer vorgeschalteten Anlage zum Extrahieren von aus Zuckerrüben gewonnenen Zuckersäften ist, entspricht nicht dieser Definition.

32. Although Articles 27 and 28 of Framework Decision 2002/584 are the reflection in the European arrest warrant system of two traditional elements of extradition law, that is to say the specialty rule and its corollary, the rule prohibiting any onward surrender, (7) the rules they lay down have been ‘acclimatised’ to the rationale underpinning the European arrest warrant, an instrument of judicial cooperation based on the principle of mutual recognition (8) and reciprocal confidence (9) between Member States which is intended to replace the traditional cooperation relations under international law (10) and is itself tailored to the specific objective of establishing an area of freedom, security and justice that is pursued by the European Union (11) as guarantor of the fundamental freedoms of the persons concerned. (12)

Zwar spiegeln die Art. 27 und 28 des Rahmenbeschlusses 2002/584 im System des Europäischen Haftbefehls zwei traditionelle Elemente des Auslieferungsrechts wider, nämlich den Grundsatz der Spezialität und den Grundsatz des Verbots weiterer Übergaben(7), doch wurden die in diesen Vorschriften aufgestellten Regelungen an die eigene Logik des Europäischen Haftbefehls „akklimatisiert“, der ein auf dem Grundsatz der gegenseitigen Anerkennung(8) und des gegenseitigen Vertrauens(9) zwischen den Mitgliedstaaten beruhendes Instrument der justiziellen Zusammenarbeit darstellt, das an die Stelle der von klassischer Kooperation geprägten völkerrechtlichen Beziehungen treten soll(10) und seinerseits an dem von der Union verfolgten spezifischen Ziel der Schaffung eines Raums der Freiheit, der Sicherheit und des Rechts(11) als Garant der Grundrechte der Betroffenen(12) ausgerichtet ist.
