7. 37 With regard to the origins of Article 11(3)(e) of Regulation No 883/2004, which are set against a background of modernisation and simplification of the rules contained in Regulation No 1408/71, it should be pointed out, as the Advocate General also stated in point 49 of his Opinion, that that provision replaced Article 13(2)(f) of Regulation No 1408/71, which provided that ‘a person to whom the legislation of a Member State ceases to be applicable, without the legislation of another Member State becoming applicable to him in accordance with one of the rules laid down in the aforegoing subparagraphs or in accordance with one of the exceptions or special provisions laid down in Articles 14 to 17, shall be subject to the legislation of the Member State in whose territory he resides’.

13 Abs. 2 Buchst. f der Verordnung Nr. 1408/71 ersetzt wurde, der vorsah, dass „eine Person, die den Rechtsvorschriften eines Mitgliedstaats nicht weiterhin unterliegt, ohne dass die Rechtsvorschriften eines anderen Mitgliedstaats gemäß einer der Vorschriften in den vorhergehenden Buchstaben oder einer der Ausnahmen bzw. Sonderregelungen der Artikel 14 bis 17 auf sie anwendbar würden, ... den Rechtsvorschriften des Mitgliedstaats [unterliegt], in dessen Gebiet sie wohnt“.
