13. In June 2003, the Commission initiated an anti-absorption reinvestigation pursuant to Article 12 of the basic anti-dumping Regulation, concerning imports of sulphanilic acid originating in the People’s Republic of China (‘PRC’) (6).

Im Juni 2003 leitete die Kommission eine Übernahmeuntersuchung gemäß Artikel 12 der Antidumpinggrundverordnung betreffend die Einfuhren von Sulfanilsäure mit Ursprung in der Volksrepublik China (nachstehend „VR China“ genannt) ein (6).

15. It has been alleged that the Polish producers maintained artificially high prices during the poor harvest of 2003 by reducing supply of frozen strawberries and that this strategy continued during the season of 2004 thus forcing the user industry to look for alternative supply in the PRC.

Ferner wurde behauptet, dass die polnischen Hersteller die Preise während der schlechten Ernte des Jahres 2003 durch Verknappung des Angebots an gefrorenen Erdbeeren gestützt und diese Strategie in der Saison 2004 weiterverfolgt hätten, was die Verarbeitungswirtschaft gezwungen hätte, auf alternative Angebote in der VR China auszuweichen.

16. However, it is also recalled that during the expiry review investigation which led to the termination of the anti-dumping measures applicable to imports of FeSi originating in Brazil, the PRC, Kazakhstan, Russia, Ukraine and Venezuela the profits realized by the Community industry in the absence of dumped imports reached levels up to 11,2%[6].

Es ist allerdings auch zu beachten, dass der Wirtschaftszweig der Gemeinschaft während der Prüfung wegen des bevorstehenden Außerkrafttretens, die zur Einstellung der Antidumpingmaßnahmen gegenüber den FeSi-Einfuhren mit Ursprung in Brasilien, der VR China, Kasachstan, Russland, der Ukraine und Venezuela führte, als keine gedumpten Einfuhren auf dem Markt waren, Gewinne bis zu 11,2 %[6] erreichte.

17. Based on the fact that during the period considered there were almost no imports of CFP from the PRC, the Commission concluded that imports of the product concerned do not represent a major proportion of the business activities of importers/traders and that there were no factors suggesting that they would be disproportionally affected if measures were maintained.

Aufgrund des Umstands, dass im Bezugszeitraum so gut wie keine Einfuhren von GFP aus der VR China erfolgten, schlussfolgerte die Kommission, dass auf die Einfuhren der betroffenen Ware kein erheblicher Teil der Geschäftstätigkeiten der Einführer/Händler entfällt und dass es keine Faktoren gibt, die darauf schließen lassen, dass sie bei einer Aufrechterhaltung der Maßnahmen unverhältnismäßig betroffen sein würden.
