46. 134 As regards the gravity of the infringement, the Commission considers, on the one hand, that the Helsinki Agreement, as a price-fixing agreement applicable in relations with customers, constitutes a particularly serious infringement and states, on the other hand, that it took into account, for the purpose of assessing the gravity of the infringement, the mitigation resulting from the abolition of the uniform rating of commissions noted at point 50 of the Decision, mitigation which is expressly mentioned under that point, to which point 78 of the Decision refers through a reference to points 46 et seq.

134 Die Helsinki-Vereinbarung als Vereinbarung über den Preis in den Beziehungen zu den Kunden stelle einen besonders schwerwiegenden Wettbewerbsverstoß dar. Bei der Beurteilung der Schwere des Verstosses habe sie jedoch die in Punkt 50 festgestellte Aufgabe der einheitlichen Gebührenordnung mildernd berücksichtigt; diese Milderung sei in Punkt 50 der Entscheidung ausdrücklich erwähnt, auf den Punkt 78 mit seiner Bezugnahme auf die Punkte 46 ff. der Entscheidung verweise.

The third persons which were not contacted were, on the one hand, private undertakings or bodies, namely Centre Professionnel des Statistiques de l' Acier ("CPS"), Darlington & Simpson, DSRM, Inter Trade, LME, Steelinter, UES and Valor and, on the other, certain administrative agencies or authorities in Member States or third countries responsible for competition matters, more specifically the Bundeskartellamt, the Office of Fair Trading, the Prisdirektoratet, the US Department of Commerce, the Direction Générale de la Concurrence, de la Consommation et de la Répression des Fraudes, together with the Permanent Representation of the Grand Duchy of Luxembourg to the European Communities.

Notes, however, the Agency’s reply explaining that the present situation reflects the balance between, on the one hand, a clear relationship with the Commission (for example the Commission may issue directives and it appoints the Director-General of the Agency) and, on the other hand, a degree of legal and financial autonomy (for example the Agency co-signs all commercial contracts related to the procurement of nuclear materials, which allows it to ensure that the policy on diversification of the sources of supply is applied); notes, furthermore that this balance is in accordance with the Euratom Treaty;
