Furthermore, in order for the principle of proportionality to be infringed in a manifest and serious manner, in such a way as to involve the Community in non-contractual liability in circumstances such as those of the present cases, there must be an error so serious that the conduct of the institution may be said to verge on the arbitrary (see the judgment in Joined Cases 116/77 and 124/77 Amylum and Tunnel Refineries v Council and Commission [1979] ECR 3497, paragraph 19).
