44. 52 In any event, the force of res judicata extends only to the grounds of a judgment which constitute the necessary support of its operative part and are, therefore, inseparable from it (judgment of 15 November 2012, Al-Aqsa v Council and Netherlands v Al-Aqsa, C‐539/10 P and C‐550/10 P, EU:C:2012:711, paragraph 49 and the case-law cited).

52 Jedenfalls erstreckt sich die Rechtskraft eines Urteils lediglich auf die Gründe eines Urteils, die den Tenor tragen und von ihm daher nicht zu trennen sind (Urteil vom 15. 45. 190 However, even if the complaint that Article 87 EC is not applicable to the measures at issue can be regarded as an amplification of the plea in law, based on the absence of State aid within the meaning of Article 87 EC, examined in paragraphs 120 to 186 above, it is clear that the complaint must in any event be rejected as inadmissible.

46. 43 In the third and last place, and in any event, it is settled case-law that a submission or argument which may be regarded as amplifying a plea made previously, whether directly or by implication, and which is closely connected therewith, will be declared admissible (judgments of 30 September 1982 in Amylum v Council, 108/81, EU:C:1982:322, paragraph 25, and 14 March 2007 in Aluminium Silicon Mill Products v Council, T‐107/04, EU:T:2007:85, paragraph 60).

September 1982, Amylum/Rat, 108/81, Slg, EU:C:1982:322, Rn. 25, und vom 14. März 2007, Aluminium Silicon Mill Products/Rat, T‐107/04, Slg, EU:T:2007:85, Rn. 60).

47. It must be found that, in any event, the legislation predating the October 2013 contested acts already provided for such an ad hominem criterion with regard to it, so that the absence of information on the amendment at issue did not cause it harm and, in particular, did not preclude it from contacting the Council in order to put forward its point of view concerning the individual nature of that criterion, if necessary following the delivery of the judgment of 16 September 2013.

Jedenfalls sah schon die Regelung, die vor den streitigen Handlungen vom Oktober 2013 galt, ein solches auf sie anwendbares persönliches Kriterium vor, so dass die fehlende Information über die betreffende Änderung ihr keinen Schaden zugefügt und ihr insbesondere nicht jede Möglichkeit genommen hat, sich an den Rat zu wenden, um – gegebenenfalls nach Verkündung des Urteils vom 16. September 2013 – ihren Standpunkt zum individuellen Charakter dieses Kriteriums zu vertreten.

48. Whereas no representations have been received by the Commission from consumers in the Community; whereas, in any event, the interest of consumers in the Community is not served in the long run by a Community industry weakened or reduced by persistent dumping; whereas, in these circumstances, protection of the Community's interests calls for the imposition of provisional anti-dumping duties on urea ammonium nitrate solution fertilizer originating in the United States of America and exported by Agrico which, having regard to the extent of injury caused, should be equal to the dumping margin found;

Es kann jedoch nicht im langfristigen Interesse der Verbraucher der Gemeinschaft liegen, wenn ein Wirtschaftszweig der Gemeinschaft durch fortgesetztes Dumping geschwächt wird oder Kapazitäten abbauen muß. Unter diesen Umständen erfordert das Interesse der Gemeinschaft die Einführung eines vorläufigen Antidumpingzolls auf Ammoniumnitrat-Harnstoff-Düngemittellösung mit Ursprung in den Vereinigten Staaten von Amerika, dessen Höhe in Anbetracht des Ausmasses der Schädigung der festgestellten Dumpingspanne entsprechen sollte.

49. 40 It should in any event be stressed that, as the Court has already held in its judgment in Case 108/81 Amylum v Council [1982] ECR 3107 with regard to the Council Decision of 21 April 1970 on the replacement of financial contributions from Member States by the Communities' own resources (Official Journal, English Special Edition 1970 (I), p. 224), the Decision of 7 May 1985, as a measure of budgetary law, has as its purpose to define own resources allocated to the Community budget and not to specify the Community institutions which are competent to impose duties, taxes, charges, levies or other forms of revenue.

40 Jedenfalls aber ist hervorzuheben, wie es der Gerichtshof bereits in seinem Urteil vom 30. September 1982 in der Rechtssache 108/81 (Amylum/Rat, Slg. 1982, 3107) im Hinblick auf den Ratsbeschluß vom 21. April 1970 über die Ersetzung der Finanzbeiträge der Mitgliedstaaten durch eigene Mittel der Gemeinschaften (ABl. L 94, S. 19) getan hat, daß mit dem Beschluß vom 7. Mai 1985 als einer haushaltsrechtlichen Maßnahme die in den Haushalt der Gemeinschaft einzusetzenden eigenen Mittel bestimmt werden sollten und nicht die für die Festsetzung von Zöllen, Steuern, Abschöpfungen, anderen Abgaben und sonstigen Formen von Einnahmen zuständigen Gemeinschaftsorgane.
