Hier sei daran erinnert, daß der nach der Rechtsprechung des Gerichtshofes unmittelbar anwendbare Artikel 59 den in ihrem Mitgliedstaat ordnungsgemäß niedergelassenen Wirtschaftsteilnehmern und den Verbrauchern "per se" das grundsätzliche, allgemeine Recht zuerkennt, grenzueberschreitend Leistungen zu erbringen bzw. zu empfangen.

Both at first instance and in the context of this appeal, the appellant’s arguments have been based to a large extent on the idea that there is a kind of automatic corollary between the existence of an acquittal in criminal proceedings and the adoption by the Court of Auditors of a decision to refrain from referring the matter to the Court of Justice under Article 247(7) EC.

Sowohl in erster Instanz als auch im Stadium des vorliegenden Rechtsmittels stützte sich das Vorbringen der Rechtsmittelführerin großteils auf den Gedanken, dass es in gewisser Weise einen automatischen Zusammenhang zwischen einem strafrechtlichen Freispruch und dem Erlass einer Entscheidung durch den Rechnungshof gebe, mit der dieser darauf verzichtet, den Gerichtshof nach Art. 247 Abs. 7 EG anzurufen.
