Außerdem habe es sich bei den von Corus auf diesem Markt verkauften nahtlosen OCTG-Rohren im Wesentlichen um Premiumgewinderohre und nicht um die in Artikel 1 der angefochtenen Entscheidung genannten Gewinderohre in Standardausführung gehandelt.

43. For that reason, the Advocate General considered, in paragraph 44 of his Opinion, that the contested provisions had no legal effect as far as the Parliament' s claims were concerned.

Wie Rn. 4 der angefochtenen Entscheidung zu entnehmen sei, werde Calciumcarbidgranulat in der Gasindustrie für die Herstellung von Acetylen verwendet, das bei Schweißarbeiten zum Einsatz komme.

53. 136 However, on the basis of the reasons stated in the contested decision and in the light of the evidence supplied in that regard by the Commission, it must be held that the Commission already had ample evidence following the inspections carried out on 19 and 20 September 2002, ITC’s leniency application of 21 September 2002 and Tréfileurope’s leniency application of 4 November 2002 (see contested decision, recitals 450 to 455).

54. Even if it is accepted that the contested decision may impose obligations on the applicants, that results from objectively determined circumstances, namely the geographical situation of the sites referred to in the annex.

Selbst wenn man unterstelle, dass die Entscheidung den Klägern Pflichten auferlegen könnte, dann wäre dies die Folge eines objektiv umschriebenen Tatbestands, nämlich der geografischen Lage der im Anhang genannten Gebiete.

55. 40 It should be noted at the outset that, by this ground of appeal, Centrotherm Systemtechnik does not allege that it asked for annulment of the contested decision before the General Court.

57. Similarly, the Commission took a selective approach, since it did not refer in the contested decision to evidence provided by ABB which was not in line with its theory, in particular the GE Agreement.

Ferner habe die Kommission eine Auswahl getroffen, da sie in der angefochtenen Entscheidung bestimmte von ABB vorgelegte Beweismittel nicht angeführt habe, die mit ihrer Theorie nicht vereinbar seien, so insbesondere das GE-Abkommen.

58. 172 The applicant further considers that the Commission did not give adequate reasons, at point 65 of the contested decision, for its assessment of the reference rent of Bass tied houses at 11.36% of turnover.

140 Der Kläger macht weiter geltend, die Kommission hätte die Festlegung des Pachtzinses der an Bass gebundenen Lokale auf 11,36 % des Umsatzes in Randnummer 65 der angefochtenen Entscheidung unzureichend begründet.

59. Since the contested decision provides no justification for the abnormally lengthy duration of the investigation procedure of more than four years and five months, it is vitiated by an error relating to the statement of reasons.

Die angefochtene Entscheidung weise, da sie keine Begründung dafür enthalte, dass das Prüfungsverfahren mehr als vier Jahre und fünf Monate gedauert habe, einen Begründungsmangel auf.

60. Furthermore, the data on which the Commission relies relate only to the ADSL retail sector and exclude products based on other broadband products, which form part of the retail market as defined in the contested decision.

Zudem beträfen die von der Kommission herangezogenen Daten nur das ADSL-Endkundensegment, nicht aber die auf anderen Breitbandprodukten beruhenden Produkte, die zum Endkundenmarkt im Sinne der Definition in der angefochtenen Entscheidung gehörten.

61. The same applies to the alleged interference with the applicant’s private and family life, since it follows from the foregoing that the contested acts do not affect the possibility which the applicant has to visit his family in France.

Dies gilt auch für den angeblichen Eingriff in das Privat- und Familienleben des Klägers, da aus den vorstehenden Erwägungen hervorgeht, dass die angefochtenen Rechtsakte ihm nicht die Möglichkeit nehmen, seine Familie in Frankreich zu besuchen.

62. 32 As appears from paragraphs 30 and 31 of the contested order, the action brought before the Court of First Instance was dismissed as manifestly inadmissible on the ground that the AIT could not show a legal interest in bringing proceedings.

32 Es ist festzustellen, dass, wie aus den Randnummern 30 und 31 des angefochtenen Beschlusses hervorgeht, die beim Gericht eingereichte Klage deswegen als offensichtlich unzulässig abgewiesen wurde, weil dem Kläger ein Rechtsschutzinteresse fehlte.

63. In that regard, they state that the recipients of the aid which the contested decision declares to be compatible with the common market are not defined in a general and abstract manner and are not all farmers or all agricultural cooperatives.

Sie führen dazu aus, dass die Empfänger der Beihilfen, die die angefochtene Entscheidung für mit dem Gemeinsamen Markt vereinbar erkläre, nicht generell und abstrakt definiert seien und es sich nicht bei allen um Landwirte oder um Landwirtschaftsgenossenschaften handele.

64. Moreover, since Alliance One’s right to claim a contribution from the applicant is based directly on the contested decision, it is difficult to understand what type of difficulties there might be in obtaining a summary judgment from the Italian court.

Zudem ergebe sich der Anspruch von Alliance One gegen die Klägerin auf Rückzahlung eines Teils der gezahlten Geldbuße direkt aus der angefochtenen Entscheidung, weshalb schwer nachzuvollziehen sei, warum sie kein Urteil eines italienischen Gerichts in einem summarischen Verfahren erlangen können sollte.

65. 17 It follows that the contested measure concerns the applicants only in their objective capacity as albacore fishermen using a certain fishing technique in a particular area, in the same way as any other economic operator in the same circumstances.

17 Die angefochtene Vorschrift betrifft die Kläger daher lediglich aufgrund ihrer objektiven Eigenschaft als Fischer von Weissem Thun, die in einem festgelegten Gebiet eine bestimmte Fischfangtechnik einsetzten, ebenso wie jeden anderen Wirtschaftsteilnehmer in gleicher Lage.

66. Moreover, neither the growth in the market shares of AMD and in its research and development investment, nor the decrease in the price of x86 CPUs over the period covered by the contested decision mean that the applicant’s practices had no effect.

Im Übrigen bedeuten weder die Zunahme des Marktanteils von AMD und ihrer Investitionen in Forschung und Entwicklung noch das Fallen des Preises für x86-Prozessoren im relevanten Zeitraum, dass die Verhaltensweisen der Klägerin wirkungslos gewesen wären.

67. 36 That requirement is not satisfied by an appeal which, without even including an argument specifically identifying the error of law allegedly vitiating the contested judgment, confines itself to reproducing the pleas in law and arguments previously submitted to the Court of First Instance.

68. It seems however unlikely that the two priority habitat types (‘Tilio-Acerion forests of slopes, screes and ravines’, and ‘Alluvial forests with Alnus glutinosa and Fraxinus excelsior’) are present in the vicinity of the contested bridge over the Elbe within the City of Dresden.

Allerdings erscheint es eher unwahrscheinlich, dass in der Nähe der streitigen Elbbrücke in der Stadt Dresden die beiden prioritären Lebensraumtypen („Schlucht- und Hangmischwälder Tilio-Acerion“ und „Auenwälder mit Alnus glutinosa und Fraxinus excelsior“) anzutreffen sind.

69. It would be contrary to the very logic of the contested regulation, which is intended to control surplus production, to exclude additional quantities from the reduction provided for by Regulation No 816/92 solely because they were acquired outside the reference quantity originally granted.

Es wäre mit dem Grundgedanken der streitigen Verordnung, die darauf abzielt, die Überproduktion unter Kontrolle zu bekommen, nicht zu vereinbaren, wenn zusätzliche Mengen von der in der Verordnung Nr. 816/92 vorgesehenen Verringerung nur deshalb ausgeschlossen würden, weil sie ausserhalb der ursprünglich gewährten Referenzmenge erworben wurden.

73. 18 In a third part of the first plea the applicants complain that Article 1 of the contested Decision prohibits the exchange of information concerning the data on deliveries of wire rod of stainless steel (Walzdraht aus Edelstahl (in the French version of the Decision this is rendered as acier inoxydable (stainless steel)). However, Walzdraht aus Edelstahl means refined (special) steel although that term does not correspond with the markets for products listed in recital 32 of the contested Decision, namely wire rod of non-alloy steel, wire rod of stainless steel, and wire rod of alloy (other than stainless) steel.

18 Im Rahmen des dritten Teils des ersten Klagegrunds führen die Klägerinnen aus, dass Artikel 1 der angefochtenen Entscheidung den Informationsaustausch hinsichtlich der Liefermengen für Walzdraht aus Edelstahl" verbiete, obgleich diese Produktbezeichnung nicht kongruent sei mit den in Randnummer 32 der Entscheidung identifizierten Produktmärkten Walzdraht aus unlegiertem Stahl, Walzdraht aus nichtrostendem Stahl und Walzdraht aus legiertem Stahl (außer nichtrostendem Stahl).

74. What the applicant is required to do in the context of a legal challenge is to identify the impugned elements of the contested decision, to formulate grounds of challenge in that regard and to adduce evidence – direct or circumstantial – to demonstrate that its objections are well founded.

Vom Kläger wird nämlich im Rahmen einer Klage verlangt, dass er die beanstandeten Punkte der angefochtenen Entscheidung bezeichnet, insoweit Rügen formuliert und Beweise oder zumindest ernsthafte Indizien für deren Begründetheit beibringt.

75. The ruling of the Besançon court cannot be relied on by the applicant against the contested decision, since it post-dates that decision (see Joined Cases T-371/94 and T-394/94 British Airways and Others and British Midland Airways v Commission [1998] ECR II-2405, paragraph 81).

In diesem Zusammenhang kann die Klägerin sich nicht auf das Urteil des Tribunal d'instance Besançon gegenüber der angefochtenen Entscheidung berufen, da es nach dieser Entscheidung ergangen ist (siehe Urteil des Gerichts vom 25. Juni 1998 in den Rechtssachen T-371/94 und T-394/94, Slg. 1998, II-2405, Randnr. 81).

76. In the light of the aforecited provisions of the contested directive, it cannot therefore be concluded that that directive contains an unlawful restriction on the fundamental freedoms of the EC Treaty, including the freedom of establishment, or that it encourages the Member States not to respect those freedoms.

Im Licht der vorgenannten Bestimmungen der angefochtenen Richtlinie kann daher nicht der Schluss gezogen werden, dass diese eine rechtswidrige Beschränkung der Grundfreiheiten des EG-Vertrags, einschließlich der Niederlassungsfreiheit, enthielte oder den Mitgliedstaaten einen Anreiz böte, diese Freiheiten nicht zu beachten.

77. 78. 97 At the hearing, the Commission withdrew its first head of claim in Case T‐456/04 contending that the Court should dismiss as inadmissible AFORS’ application for annulment of Article 1 of the contested decision; formal note of this was taken in the minutes of the hearing.

79. It must be observed, first, that the document of 19 November 2001 was not referred to by the Commission to show the existence of the ‘Imports’ part, but as an example of the local application of the price scale (see recital 86 of the contested decision and paragraph 114 above).

80. 22 Dürbeck contends that by the contested clause Consultban was seeking solely to protect itself against claims for compensation which, in the context of contracts of affreightment, the shipowners could bring against it if Dürbeck terminated the contract with Consultban for reasons other than those set out in the contract.
