39. Nach Ansicht der Kommission sollte die finanzielle Unterstützung für Bulgarien und Rumänien ab dem Zeitpunkt der ersten Beitrittsrunde nach Maßgabe der bei der Umsetzung der Fahrpläne erzielten Fortschritte und ihre Absorptionsfähigkeitdeutlich aufgestockt werden.

40. Die Anwendung der mit den genannten Abkommen vorgesehenen Regelung ist durch die Verordnung (EG) Nr. 1588/94 der Kommission (5) geregelt. Diese Abkommen wurden am 30. Juni 1994 durch Schriftwechsel zwischen der Gemeinschaft und Bulgarien bzw. Rumänien (6) geändert, damit bestimmte, insbesondere für 1993 vorgesehene Kontingente und Hoechstmengen übertragen werden können. Diese Maßnahmen sind erforderlich, damit Rumänien und Bulgarien für die verspätete Anwendung bestimmter landwirtschaftlicher Maßnahmen des betreffenden Abkommens ein Ausgleich gewährt werden kann. Die Verordnung (EG) Nr. 1588/94 ist deshalb anzupassen.

Whereas Commission Regulation (EC) No 1588/94 of 30 June 1994 (5) lays down the detailed rules for the application of the arrangements provided for in those Agreements; whereas, by an Exchange of Letters on 30 June 1994 between the Community and Bulgaria and Romania respectively (6), the Interim Agreements were amended so that certain quotas and ceilings laid down for 1993 might be transferred; whereas the relevant measures are required to compensate Romania for the late application of certain agricultural concessions provided for in the Interim Agreement and the Republic of Bulgaria for the late entry into force of the Interim Agreement; whereas Regulation (EC) No 1588/94 must be amended accordingly;

43. 7 Am 25. Juni 2008 unterzeichneten der Bundesrat der Schweizerischen Eidgenossenschaft, der Ratspräsident und die Kommission einen vom Ratspräsidenten mit Unterstützung der Kommission ausgehandelten Nachtrag zur Vereinbarung, der die Anpassung des finanziellen Beitrags der Schweiz im Hinblick auf den Beitritt der Republik Bulgarien und Rumäniens zur Europäischen Union betraf.

Der Hof verweist darauf, dass die bislang erstellten Regeln nicht kohärent sind, denn in den die Regelung für die einheitliche Flächenzahlung anwendenden Mitgliedstaaten, die der EU im Jahr 2004 beitraten, können Betriebsinhaber, die Parzellen wieder bewirtschaften wollen, nicht in den Genuss einheitlicher Flächenzahlungen für diese Parzellen kommen, während Betriebsinhaber in Bulgarien und Rumänien im Falle der Nutzung zuvor aufgegebener Flächen solche Beihilfen erhalten.

The Court notes that the rules as established to date are incoherent as farmers who want to take parcels back into cultivation in the SAPS Member States that joined the EU in 2004 are excluded from SAPS aid with respect to such parcels while in Bulgaria and Romania farmers received SAPS aid where they farm formerly abandoned land.
