1. On account of its abstract and indeterminable nature, the concept of energy solidarity is not justiciable.

2. The problems of minorities accentuated the need of having a formal declaration of certain justiciable fundamental rights in the text of the Constitution itself .

3. Constitutionalism - Constitutionalism - Political and legal Constitutionalism compared: An entrenched, rights-based, and justiciable (that is, liable to trial in a court of justice) constitution is said to ensure stable and accountable government, obliging legislatures and executives to operate according to the established rules and procedures.

4. Affirming the principle of the interdependence and indivisibility of all human rights, and that all economic, social and cultural rights are justiciable, the Committee reiterates its previous recommendation (see paragraph 21 of its 1997 concluding observations) and strongly recommends that the State party re-examine the matter of incorporation of the International Covenant on Economic, Social and Cultural Rights in domestic law.
