1. None of the councillors on the Appeal Committee would want to attend an appeal on Christmas Eve.

2. They accordingly reversed the judge's decision to quash and restored the decisions of the appeal committee in both cases.

3. The independent Appeal Committee, chaired by Rod McKenzie (Scotland) and also comprising Achille Reali (Italy) and Chris Quinlan (England), heard submissions made on behalf of Marius Tincu and ERC and have now retired to deliberate on the case and intend to communicate their full decision to Marius Tincu and ERC by Friday, 14 November, 2008.
