58. (a) & (b) As stated in the Joint Press Statement issued after Prime Minister’s visit to Nepal on 4 August 2014, the two sides agreed to review, adjust and update the Treaty of Peace and Friendship of 1950 and other bilateral agreements.

59. Noting that increased mobility of capital and technology have created new opportunities for avoiding tax and profit shifting, the Prime Minister said he urged every jurisdiction, especially tax havens, to provide information for tax purposes in accordance with treaty obligations.

60. It is pertinent to note the ever growing number of cross border disputes between commercial entities which also draw States into these, sometimes on account of their far reaching policy implications, in other cases on account of high values and yet others because of treaty provisions.

यह नोट करना उचित है वाणिज्यिक संस्थाओं के बीच सीमा पार विवादों की बढ़ती संख्या जो इनमे भी राज्यों को आकर्षित करती है, कभी कभी उनके दूरगामी नीति निहितार्थ के कारण, अन्य मामलों में उच्च मूल्यों के कारण और अन्य मामलों में संधि के प्रावधानों के कारण।

61. * Accordingly, India's design of sluice spillway at Baglihar with five outlets is regarded as appropriate and permissible under the Treaty for sediment control of the reservoir and evacuation of a large part of the design flood and being in conformity with the international practice and the state of the art.

* तदनुसार, बगलिहार में पांच निकास द्वारों के साथ स्लूस स्पिलवे की भारतीय डिजाइन, जलाशय के सेडीमेंट नियंत्रण और डिजाइन बाढ़ के विशाल भाग को खाली करने का इस संधि के अंतर्गत उचित और स्वीकार्य समझा गया है तथा अंतर्राष्ट्रीय पद्धति और अत्याधुनिक प्रौद्योगिकी के अनुरुप माना गया है ।

62. They underscored the need for effective operationalization of the bilateral Extradition Treaty and, in this regard, welcomed the addendum signed during the visit of Home Minister of Bangladesh to India in July 2016. They also lauded the exemplary cooperation on checking the smuggling and circulation of fake currency notes and narcotics.

The NE has adopted the principle of effective interpretation which gives full effect to the rights and obligations provided by the Treaty, taking into account its object and purpose set out in the Preamble which is "attaining the most complete and satisfactory utilization of the waters of the Indus System of rivers”.

The GGE Report was of immense value in bringing together, Governmental experts from 25 countries, ably chaired by Ambassador Elissa Golberg, who brought to bear varied but enriching perspectives on various aspects of a future treaty thus deepening our understanding of its many complexities, which only a serious, non-polemical and interactive discussion can bring forth.

65. Pakistan contended, inter alia, that conditions at the Baglihar site did not require a gated spillway; that the spillway gates were not at the highest level; Indian calculations of the design flood and the height of the dam (Freeboard) were excessive; India's calculation of the required Pondage of 37.5 MCM was also too high as the correct Pondage should be 6.22 MCM; and that the level of intakes for the Power Plant were not at the highest level as required by the Treaty.

पाकिस्तान ने अन्य बातों के साथ-साथ यह भी कहा था कि बगलिहार कार्यस्थल की परिस्थितियों में गेटयुक्त स्पिलवे की आवश्यकता नहीं है; कि स्पिलवे गेट उच्चतम स्तर पर नहीं थे; बाँध की डिजाइन बाढ़ और ऊँचाई (फ्रीबोर्ड) की भारतीय गणना अत्यधिक थी; 37.5 मिलियन घन मीटर की अपेक्षित जलाशय क्षमता की भारत की गणना भी बहुत अधिक थी क्योंकि जलाशय की सही क्षमता 6.22 मिलियन घन मीटर होनी चाहिए; और विद्युत संयंत्र के लिए अंतर्ग्रहण का स्तर उच्चतम स्तर पर नहीं था जैसा कि संधि में अपेक्षित है ।

66. * The NE after a detailed analysis of a data base of about 13000 dams from the International Commission on Large Dams (ICOLD)'s World Register of Dams to analyse the type of spillway, gated or ungated, and a historical review of construction of large orifice outlets as well as a consideration of ICOLD guidelines, held that the site conditions at Baglihar require a gated spillway, and also held that in view of the high flood discharges and heavy silt loads, India's design of gated spillways – both chute (surface) spillway and sluice spillways, as well as the number, size and location of their gates for the Baglihar dam complies with the design criteria set out in Annexure D of the Indus Waters Treaty.

* तटस्थ विशेषज्ञ ने स्लिपवे के स्वरुप, गेटयुक्त हो अथवा गेट रहित इसके विश्लेषण के लिए अंतर्राष्ट्रीय बृहद बाँध आयोग (आईसीओएलडी) के बांधों के विश्व रजिस्टर से लगभग 13000 बांधों के डाटाबेस के गहन विश्लेषण, विशाल छिद्र निकासी के निर्माण की ऐतिहासिक समीक्षा तथा आईसीओएलडी के दिशानिर्देशों पर विचार-विमर्श के बाद यह माना कि बगलिहार में कार्यस्थल की परिस्थितियों में गेटयुक्त स्पिलवे आवश्यक है और यह भी माना कि अधिक पानी छोड़ने और भारी सिल्ट भार को देखते हुए गेटयुक्त स्पिलवे – दोनों शूट (सतह) स्पिलवे और स्लूस स्पिलवे दोनों की भारतीय डिजाइन, बगलिहार बाँध के लिए गेटों की संख्या, आकार और स्थान, सिंधु जल संधि के अनुबंध-घ में निर्धारित डिजाइन मापदंड को पूरा करते हैं ।
