• हितलाभ की हानि रोकने के लिए अंशदान अवधि (दो देशों में) का राशिकरणः सामाजिक सुरक्षा समझौता संपन्न् हो जाने से भारतीय कामगार/व्यावसायिक को भारत तथा बाहर के किसी देश में किए गए सामाजिक सुरक्षा अंशदान से संबद्ध रेजिडेन्सी अवधि का राशिकरण करने की अनुमति मिल जाती है और वे सेवानिवृत्ति हितलाभों के लिए अर्हता प्राप्त कर लेते हैं।

68. c) Aggregating the contribution periods (in two countries) to prevent loss of benefits (Totalization): An SSA allows aggregating residency periods of social security contribution made by the Indian worker / professional in India and the foreign country to qualify for retirement benefits.

ग) अंशदान अवधि (दोनों देशों में) कुल लाभ की हानि (संपूर्ण हानि) को रोकने के लिए: एसएसए भारतीय कार्यकर्ताओं/पेशेवरों को भारत में और विदेशों में सामाजिक सुरक्षा योगदान में दिए गये कुल समय को सेवानिवृत्ति लाभों के लिए अर्हता प्राप्त करने के लिए अनुमति देता है।

69. * Bilateral social security agreements protect the interests of professionals, skilled workers working abroad by helping them avoid making double social security contributions; enable easy remittance of benefits (exportability); and aggregate the contribution periods (in two countries) to prevent loss of benefits (totalization).

* द्विपक्षीय सामाजिक सुरक्षा समझौता डबल सामाजिक सुरक्षा योगदान करने से बचने के द्वारा विदेशों में काम कर रहे कुशल श्रमिकों और पेशेवरों के हितों की रक्षा करता है; लाभ के लिए आसान प्रेषण को सक्षम बनाता है (exportability) और लाभ (Totalization) के नुकसान को रोकने के लिए योगदान अवधि का (दो देशों में) जोड़ करता है।

70. The Indian Missions receive complaints from Indian workers against their sponsors regarding non-payment/less payment of salaries, non-issuance/renewal of residence permits, refusal to grant exit/re-entry permits for visit to India, refusal to allow the worker on final exit visa etc.

भारतीय मिशनों को भारतीय कामगारों से उनके प्रायोजकों के विरुद्ध वेतन का भुगतान नहीं करने/कम वेतन देने, आवासीय परमिट जारी नहीं करने/उसका नवीनीकरण न करने, निकासी अनुमति देने के लिए मना करने/भारत यात्रा के लिए पुनः प्रवेश परमिट न देने, अंतिम निकासी वीज़ा आदि के लिए कामगारों को अनुमति देने से मना करना आदि के बारे में शिकायतें प्राप्त होती हैं।

71. (a) & (b) The Government is aware that in addition to several measures taken by the United States that have adversely affected the mobility of skilled professionals from India to the United States, there is also a growing protectionist tendency against the development of international supply chain in the services industry.

(क) एवं (ख) सरकार को इस बात की जानकारी है कि भारत से अमरीका में कुशल व्यावसायिकों के आवागमन पर प्रतिकूल प्रभाव डालने के संदर्भ में अमरीकी सरकार द्वारा कई उपाय किए गए हैं, और इसके अलावा सेवा उद्योग में अंतर्राष्ट्रीय आपूर्ति चक्र के विरुद्ध संरक्षणवाद की बढ़ती प्रवृत्ति भी बढ़ रही है।

72. While the current Bill is not expected to impact adversely against foreign students, including from India, Indian IT industry has raised concerns over some measures in the Bill that relate to skilled non-immigrant visas, which, if brought into force, after the completion of US Congressional processes in both Houses, is likely to place more onerous requirements on H1-B/L-1 visa dependent firms including higher wages; enhanced audit by U.S. agencies; non-displacement guarantee/additional recruitment notice requirements; and higher visa fees.
