(क) एवं (ख) वर्तमान विनियमों के अनुसार वैध ओसीआई (प्रवासी भारतीय नागरिक) कार्डधारक भारतीय मूल के लोगों को भारत यात्रा हेतु उनके पासपोर्ट पर हर बार वीजा लगवाने की आवश्यकता नहीं है।

54. The Government of India has set up Indian Community Welfare Fund (ICWF) in all the Indian Missions/consulates abroad to meet contingency expenditure incurred by them for carrying out various welfare activities for overseas Indian citizens who are in distress.

55. (a) As per the current regulations, the people of Indian origin holding a valid Overseas Citizen of India (OCI) Card along with a valid foreign passport do not require to get a visa affixed on their passports every time they travel to India.

(क) वर्तमान विनियमों के अनुसार, वैध प्रवासी भारतीय नागरिक (ओसीआई) कार्ड तथा वैध विदेशी पासपोर्ट धारक भारतीय मूल के लोगों को प्रत्येक बार भारत की यात्रा करते समय अपने पासपोर्टों पर वीजा लगाने की जरूरत नहीं होती।

56. When the aggrieved Indian woman files a case in India or in the foreign country seeking restitution of marital rights, serving judicial summons on the overseas Indian spouse becomes difficult as in most cases his address abroad is either incorrect or not known.

जब पीड़ित भारतीय महिला वैवाहिक अधिकारों की बहाली के लिए भारत या विदेश में मुकदमा दायर करती है तो, विदेश में रहने वाले भारतीय पति को न्यायिक समन जारी करना मुश्किल हो जाता है क्योंकि ज़्यादातर मामलों में विदेश स्थित उनके पते सही नही होते या फिर अज्ञात होते हैं।

Assistance provided through the scheme has enabled the Indian women, to meet legal costs such as documentation and preparatory work for filing a case against the overseas Indian spouse and other aspects of judicial proceedings; to avail counseling and, in some cases for financial support for sustenance, accommodation, etc.

इस योजना के माध्यम से भारतीय महिलाओं को विधिक लागत जैसे विदेशी भारतीय पतियों के विरुद्ध मुकदमा दायर करने के लिए दस्तावेज तथा प्रारंभिक कार्य तथा न्यायिक कार्यवाही के अन्य पहलुओं, कौंसुली सहायता प्राप्त करने में और कुछ मामलों में संपोषण, आवास आदि के लिए वित्तीय सहयोग में सहायता मिलती है।

The Union Cabinet chaired by Prime Minister Shri Narendra Modi has given its approval for closure of India Development Foundation of Overseas Indians (IDF-OI) to enhance synergies in channelizing Diaspora’s contributions to Government of India’s flagship programmes such as National Mission for clean Ganga and Swachh Bharat Mission.

62. From our perspective, our priorities of this G20 Summit are going to be, the cross-border mobility of professionals, particularly in services, the reduction in remittance costs from overseas Indians, poverty eradication, moderation in consumption and more sustainable lifestyles and improved technology access particularly for renewable and post-harvest agriculture activities.

हमारे दृष्टिकोण से इस जी -20 शिखर सम्मेलन की हमारी प्राथमिकताएं पेशेवरों की सीमा पार से गतिशील, विशेष रूप से सेवाओं में, प्रवासी भारतीयों से प्रेषण की लागत में कमी, गरीबी उन्मूलन, खपत में कमी और विशेष रूप से अक्षय और फसल कटाई के बाद कृषि गतिविधियों के लिए अधिक स्थायी जीवन शैली और बेहतर प्रौद्योगिकी की पहुँच, होंगी।

63. (a) This Ministry maintains data relating to emigration of workers, i.e. Emigration Check Required (ECR) category passport holders proceeding for overseas employment to the 18 notified ECR countries; namely Afghanistan, Bahrain, Indonesia, Iraq, Jordan, Kuwait, Lebanon, Libya, Malaysia, Oman, Qatar, Saudi Arabia, Sudan, South Sudan, Syria, Thailand, UAE and Yemen.

(क) यह मंत्रालय 18 अधिसूचित ईसीआर देशों अर्थात अफगानिस्तान, बहरीन, इंडोनेशिया, इराक, जॉर्डन, कुवैत, लेबनान, लीबिया, मलेशिया, ओमान, कतर, सऊदी अरब, सूडान, दक्षिणी सूडान, सीरिया, थाईलैंड, संयुक्त अरब अमीरात तथा यमन में विदेशों में रोजगार के लिए जाने वाले उत्प्रवासन जांच अपेक्षित (ईसीआर) श्रेणी के पासपोर्टधारक श्रमिकों के उत्प्रवासन से संबंधित आंकड़े रखता है।

64. (b) & (c) The Government has accepted the recommendation of the Expert Committee set up under the chairmanship of Justice Arvind Kumar Goel, ex-Chairperson, NRI Commission Punjab, to look into the issues and difficulties faced by Indian nationals married to overseas nationals of Indian origin, and suggested amendments in existing laws/policies/regulation.

(ख) और (ग) सरकार ने भारतीय मूल के प्रवासी नागरिकों से विवाहित भारतीय महिलाओं द्वारा झेली जा रही समस्याओं तथा कठिनाइयों का निराकरण करने और मौजूदा कानूनों/नीतियों/विनियमों में संशोधन करने का सुझाव देने के लिए न्यायाधीश अरविन्द कुमार गोयल, पूर्व अध्यक्ष, एनआरआई आयोग, पंजाब की अध्यक्षता में गठित विशेषज्ञ समिति की सिफारिशों को स्वीकार कर लिया है।

65. Ministry is empowering the aggrieved Indian women by providing information and guidance about procedures, mechanisms for serving judicial summons on the overseas Indian husband; filing a case in Indian courts or police station; issuing Look out Circulars; impounding and cancelling of Indian passport of the husband; lawyers and NGOs empanelled with Indian Missions etc.

विदेश स्थित भारतीय पतियों को कानूनी समन भेजना, भारतीय न्यायालय या पुलिस स्टेशन में मामला दायर करना, लुक आउट परिपत्र जारी करने, पति के भारतीय पासपोर्ट को निरस्त और परिबद्ध करने की प्रक्रियाओं, इससे संबंधित तंत्रों की जानकारी देने व मार्गदर्शन करने, भारतीय मिशनों में पैनलबद्ध वकीलों और गैर-सरकारी संगठनों आदि की जानकारी देने जैसी सहायता देकर, मंत्रालय व्यथित भारतीय महिलाओं को सशक्त बना रहा है।

66. (d) Ministry is empowering the aggrieved Indian women by providing information and guidance about procedures, mechanisms for serving judicial summons on the overseas Indian husband; filing a case in India; issuing Look out Circulars; impounding and revocation of Indian passport of the husband; getting access to lawyers and NGOs empanelled with Indian Missions etc.

(घ) मंत्रालय प्रवासी भारतीय पति को न्यायिक समन जारी करने संबंधी कार्य प्रक्रियाओं, तंत्रों के बारे में सूचना एवं मार्गदर्शन मुहैया कराकर; भारत में मामला दर्ज कराकर; लुक आउट परिपत्र जारी करके; पति का भारतीय पासपोर्ट जब्त करके और उसे रद्द करके; भारतीय मिशनों इत्यादि के पैनल में दर्ज वकीलों और गैर-सरकारी संगठनों तक पहुंच सुलभ कराके व्यथित भारतीय महिलाओं को सशक्त बना रहा है।

67. (ख) से (ङ) सरकार ने भारतीय मूल के विदेशी नागरिकों से विवाहिता भारतीय महिलाओं के समक्ष आ रही समस्याओं तथा कठिनाइयों पर विचार करने और मौजूदा कानूनों/नीतियों/विनियमों में संशोधन का सुझाव देने के लिए न्यायमूर्ति अरविन्द कुमार गोयल, पूर्व अध्यक्ष, एनआरआई आयोग, पंजाब की अध्यक्षता में एक विशेषज्ञ समिति गठित की थी।

68. (c) Of 3328 complaints received, 3268 were addressed by way of providing them counseling, guidance and information about procedures, mechanisms for serving judicial summons on the overseas Indian husband; filing a case in India, issuing Look Out Circulars; impounding and revocation of Indian passport of the husband; getting access to lawyers and NGOs empanelled with Indian Missions etc. and legal and financial assistance under ICWF.

(ग) प्राप्त 3328 शिकायतों में से 3268 मामलों में पत्नियों को और उनके प्रवासी भारतीय पतियों को न्यायिक समन भेजने की प्रक्रियाओं व प्रणालियों की जानकारी देने; भारत में मुकदमा दर्ज कराने; लुक आउट परिपत्र जारी करने की मांग करने, पतियों के भारतीय पासपोर्ट जब्त करके उन्हें निरस्त करने; भारतीय मिशनों में पेनलबद्ध वकीलों तथा एनजीओ की सहायता प्राप्त करने तथा आईसीडब्ल्यूएफ के अंतर्गत दी जाने वाली कानूनी व वित्तीय सहायता के बारे में परामर्श, मार्गदर्शन और सूचनाएं देकर उनका समाधान किया गया।

69. (b) Of 3328 complaints received during the last three years (January 2015 to November, 2017) from distressed Indian women deserted by their NRI spouses, this Ministry has addressed 3268 complaints by way of providing them counseling, guidance and information about procedures, mechanisms for serving judicial summons on the Overseas Indian husband; filing a case in India, issuing Look Out Circulars; getting access to lawyers and NGOs empanelled with Indian Missions etc.

(ख) संकटग्रस्त भारतीय महिलाओं से उनके अनिवासी भारतीय पतियों द्वारा त्यागे जाने के आधार पर विगत तीन वर्षों (जनवरी 2015 से नवंबर 2017) के दौरान प्राप्त 3328 शिकायतों में से इस मंत्रालय ने सलाह, मार्गदर्शन और प्रक्रिया के बारे में सूचना, प्रवासी भारतीय पति को न्यायिक समन तामील करने की प्रणाली, भारत में मामला दर्ज कराने, लुक आउट सर्कुलर जारी कराने; भारतीय मिशनों में पैनलबद्ध अधिवक्ताओं और एनजीओ से संपर्क आदि के द्वारा 3268 शिकायतों का समाधान कर दिया है।

70. This Ministry (including the Indian Missions abroad) has addressed these complaints of distressed Indian women deserted by their NRI spouses by way of providing them counseling, guidance and information about procedures, mechanisms for serving judicial summons on the Overseas Indian husband; filing a case in India, issuing Look Out Circulars; impounding and revocation of Indian passport of the husband; getting access to lawyers and NGOs empanelled with Indian Missions etc.

इस मंत्रालय (विदेश स्थिंत भारतीय मिशनों को शामिल करते हुए) ने अनिवासी भारतीय पतियों द्वारा छोड़ी गयी परेशान भारतीय महिलाओं को परामर्श, मार्गदर्शन और प्रक्रियाओं की जानकरी, उनके प्रवासी भारतीय पतियों को न्याीयिक समन जारी कराने का तंत्र उपलब्धश कराने, भारत में मामलों को दायर करने, लुक आउट सर्कुलर जारी करने, पतियों के भारतीय पासपोर्ट को जब्तन करने और रद्द करने और भारतीय मिशनों के पास सूचीबद्ध वकीलों और एनजीओं से संपर्क करने में सहायता करके उनकी समस्याओं के निराकरण में सहायता की है।
