तथापि, यदि किसी भी एक अभिभावक (माता अथवा पिता) की सहमति उपलब्ध नहीं है, तो अवयस्क के पासपोर्ट हेतु आवेदन करने वाले अभिभावक के द्वारा न्यायिक मजिस्ट्रेट की उपस्थिति में अनुबंध-ग अथवा अनुबंध-छ के प्रपत्र में शपथ-पत्र दाखिल किया जाना होता है।

73. 74. When the aggrieved Indian woman files a case in India or in the foreign country seeking restitution of marital rights, serving judicial summons on the overseas Indian spouse becomes difficult as in most cases his address abroad is either incorrect or not known.

जब पीड़ित भारतीय महिला वैवाहिक अधिकारों की बहाली के लिए भारत या विदेश में मुकदमा दायर करती है तो, विदेश में रहने वाले भारतीय पति को न्यायिक समन जारी करना मुश्किल हो जाता है क्योंकि ज़्यादातर मामलों में विदेश स्थित उनके पते सही नही होते या फिर अज्ञात होते हैं।

75. Justice H R Khanna of the Supreme Court had observed : Another thing which is shaking the confidence of the people in the judicial system is the high incidence of acquittals and the increasing failure of the system to bring major culprits to book .

उच्चतम न्यायालय के न्यायमूर्ति एच . आर . खन्ना ने कहा था : एक अन्य बात जो न्यायतंत्र में लोगों के विश्वास को डिगा रही है , वह है दोषमुक्ति के मामलों की भारी संख्या और बडे अपराधियों को दंडित करने की न्यायतंत्र की बढती असफलता .

76. When the Prime Minister mentioned that it would be a great CBM if things would move forward, there is this argument which we hear from Pakistan that their Judicial Commission was not given proper access and that actually was not accepted by the court subsequently.

जब प्रधानमंत्री जी ने कहा कि इस संबंध में यदि बात आगे बढ़ती है तो यह एक बड़ा विश्वासोत्पादक उपाय होगा परंतु पाकिस्तान तर्क देता आ रहा है कि उनकी न्यायिक आयोग को उपयुक्त पहुँच नहीं प्रदान की गयी और इसीलिए इसे वस्तुतः न्यायालय द्वारा स्वीकार नहीं किया गया।

77. The assistance enables the aggrieved Indian women to meet legal costs such as documentation and preparatory work for filing a case against the overseas Indian spouse and other aspects of judicial proceedings; avail counseling and in some cases for financial support for sustenance, accommodation, etc.

यह सहायता पीड़ित भारतीय स्त्रियों को प्रवासी भारतीय पतियों के खिलाफ मामला दायर करने के लिए दस्तावेजों और तैयारीमूलक कार्य और न्यायिक कार्यवाहियों के अन्य पहलुओं पर सलाह प्राप्त करने और कुछ मामलों में जीवन-यापन, आवास आदि जैसे कानूनी खर्चों को वहन करने के लिए सक्षम करती है।

78. The last of the commissions was formed in 2000 under retired judge Nanavati who held public hearings and invited fresh affidavits but as with the very first judicial inquiry held by the Misra commission, it admitted that the attacks were organized and yet failed to attribute responsibility.

अंतिम आयोग साल 2000 में सेवानिवृत्त न्यायाधीश नानावती के अधीन गठित किया गया जिन्होंने सार्वजनिक सुनवाई की और नए हलफनामे आमंत्रित किए. मिश्रा आयोग की पहली न्यायिक जांच की ही तरह इसने भी माना कि हमले सुनियोजित थे लेकिन इसने भी जिम्मेदारी तय नहीं की.

79. Assistance provided through the scheme has enabled the Indian women, to meet legal costs such as documentation and preparatory work for filing a case against the overseas Indian spouse and other aspects of judicial proceedings; to avail counseling and, in some cases for financial support for sustenance, accommodation, etc.

इस योजना के माध्यम से भारतीय महिलाओं को विधिक लागत जैसे विदेशी भारतीय पतियों के विरुद्ध मुकदमा दायर करने के लिए दस्तावेज तथा प्रारंभिक कार्य तथा न्यायिक कार्यवाही के अन्य पहलुओं, कौंसुली सहायता प्राप्त करने में और कुछ मामलों में संपोषण, आवास आदि के लिए वित्तीय सहयोग में सहायता मिलती है।

80. (c) Under the Vienna Convention on Diplomatic Relations the members of the family of a diplomatic agent forming part of his household shall enjoy the privileges and immunities enumerated in the relevant provisions and clauses, inclusive of personal inviolability of a diplomatic agent, absolute immunity from criminal jurisdiction of the receiving state etc. as set out in the Convention.

(ग) राजनयिक संबंधों पर वियना अभिसमय के अंतर्गत किसी राजनयिक एजेंट के परिवार के सदस्य, जो उसके घर के भाग हैं, संगत उपबंधों एवं धाराओं में विनिर्दिष्ट सुविधाओं एवं उन्मुक्तियों का उपभोग करेंगे, जिसमें अभिसमय में निर्धारित एक राजनयिक एजेंट की अनतिक्रम्यता, प्राप्तकर्ता राज्य के आपराधिक क्षेत्राधिकार से पूर्ण उन्मुक्ति शामिल है।
