1. The Passports Act, 1967 does not provide any specific provision for variation, impounding and revocation of passports of ‘absconders’ evading the proceedings of a criminal court.

पासपोर्ट अधिनियम 1967, में आपराधिक न्यायालय की कार्यवाही से बचने के लिए फरार व्यक्ति के पासपोर्ट में फेरफार करने, उन्हें परिबद्ध करने और प्रतिसंहृत करने का कोई विशेष प्रावधान नहीं है।

2. * The Ministry of External Affairs should institute efficient internal control system to ensure full compliance with rules in regard to impounding/revoking of the passports and determine accountability for non-compliance.

* विदेश मंत्रालय को पासपोर्टे जब्त करने/प्रतिसंहरण करने के संबंध में नियमों के पूर्ण पालन को सुनिश्चित करने के लिए सक्षम आंतरिक नियंत्रण प्रणाली स्थापित करनी चाहिए और उसका अनुपालन न किए जाने पर उत्तरदायित्व निर्धारित किया जाना चाहिए ।

3. Ministry is empowering the aggrieved Indian women by providing information and guidance about procedures, mechanisms for serving judicial summons on the overseas Indian husband; filing a case in Indian courts or police station; issuing Look out Circulars; impounding and cancelling of Indian passport of the husband; lawyers and NGOs empanelled with Indian Missions etc.

विदेश स्थित भारतीय पतियों को कानूनी समन भेजना, भारतीय न्यायालय या पुलिस स्टेशन में मामला दायर करना, लुक आउट परिपत्र जारी करने, पति के भारतीय पासपोर्ट को निरस्त और परिबद्ध करने की प्रक्रियाओं, इससे संबंधित तंत्रों की जानकारी देने व मार्गदर्शन करने, भारतीय मिशनों में पैनलबद्ध वकीलों और गैर-सरकारी संगठनों आदि की जानकारी देने जैसी सहायता देकर, मंत्रालय व्यथित भारतीय महिलाओं को सशक्त बना रहा है।

(d) Ministry is empowering the aggrieved Indian women by providing information and guidance about procedures, mechanisms for serving judicial summons on the overseas Indian husband; filing a case in India; issuing Look out Circulars; impounding and revocation of Indian passport of the husband; getting access to lawyers and NGOs empanelled with Indian Missions etc.

(घ) मंत्रालय प्रवासी भारतीय पति को न्यायिक समन जारी करने संबंधी कार्य प्रक्रियाओं, तंत्रों के बारे में सूचना एवं मार्गदर्शन मुहैया कराकर; भारत में मामला दर्ज कराकर; लुक आउट परिपत्र जारी करके; पति का भारतीय पासपोर्ट जब्त करके और उसे रद्द करके; भारतीय मिशनों इत्यादि के पैनल में दर्ज वकीलों और गैर-सरकारी संगठनों तक पहुंच सुलभ कराके व्यथित भारतीय महिलाओं को सशक्त बना रहा है।

5. (c) Of 3328 complaints received, 3268 were addressed by way of providing them counseling, guidance and information about procedures, mechanisms for serving judicial summons on the overseas Indian husband; filing a case in India, issuing Look Out Circulars; impounding and revocation of Indian passport of the husband; getting access to lawyers and NGOs empanelled with Indian Missions etc. and legal and financial assistance under ICWF.

(ग) प्राप्त 3328 शिकायतों में से 3268 मामलों में पत्नियों को और उनके प्रवासी भारतीय पतियों को न्यायिक समन भेजने की प्रक्रियाओं व प्रणालियों की जानकारी देने; भारत में मुकदमा दर्ज कराने; लुक आउट परिपत्र जारी करने की मांग करने, पतियों के भारतीय पासपोर्ट जब्त करके उन्हें निरस्त करने; भारतीय मिशनों में पेनलबद्ध वकीलों तथा एनजीओ की सहायता प्राप्त करने तथा आईसीडब्ल्यूएफ के अंतर्गत दी जाने वाली कानूनी व वित्तीय सहायता के बारे में परामर्श, मार्गदर्शन और सूचनाएं देकर उनका समाधान किया गया।

6. This Ministry (including the Indian Missions abroad) has addressed these complaints of distressed Indian women deserted by their NRI spouses by way of providing them counseling, guidance and information about procedures, mechanisms for serving judicial summons on the Overseas Indian husband; filing a case in India, issuing Look Out Circulars; impounding and revocation of Indian passport of the husband; getting access to lawyers and NGOs empanelled with Indian Missions etc.

इस मंत्रालय (विदेश स्थिंत भारतीय मिशनों को शामिल करते हुए) ने अनिवासी भारतीय पतियों द्वारा छोड़ी गयी परेशान भारतीय महिलाओं को परामर्श, मार्गदर्शन और प्रक्रियाओं की जानकरी, उनके प्रवासी भारतीय पतियों को न्याीयिक समन जारी कराने का तंत्र उपलब्धश कराने, भारत में मामलों को दायर करने, लुक आउट सर्कुलर जारी करने, पतियों के भारतीय पासपोर्ट को जब्तन करने और रद्द करने और भारतीय मिशनों के पास सूचीबद्ध वकीलों और एनजीओं से संपर्क करने में सहायता करके उनकी समस्याओं के निराकरण में सहायता की है।
