75. When parents of well-adjusted young adults were asked what advice they could offer other parents, among the most frequent responses were: ‘Love abundantly,’ ‘spend time together,’ ‘develop mutual respect,’ ‘really listen to them,’ ‘offer guidance rather than a speech,’ and ‘be realistic.’

77. * Accordingly, India's design of sluice spillway at Baglihar with five outlets is regarded as appropriate and permissible under the Treaty for sediment control of the reservoir and evacuation of a large part of the design flood and being in conformity with the international practice and the state of the art.

* तदनुसार, बगलिहार में पांच निकास द्वारों के साथ स्लूस स्पिलवे की भारतीय डिजाइन, जलाशय के सेडीमेंट नियंत्रण और डिजाइन बाढ़ के विशाल भाग को खाली करने का इस संधि के अंतर्गत उचित और स्वीकार्य समझा गया है तथा अंतर्राष्ट्रीय पद्धति और अत्याधुनिक प्रौद्योगिकी के अनुरुप माना गया है ।

78. * The NE observes that the designer of a spillway is not only faced with the problem of flood control but also with that of sediment control and cites the "ICOLD” to note that the state of the art is today that "Bottom outlets may be used for under sluicing of floods, emptying of reservoirs, sluicing of sediments and preventing sediment from entering intakes etc.”

* तटस्थ विशेषज्ञ ने कहा है कि स्पिलवे की डिजाइन निर्माता के सामने बाढ़ नियंत्रण की समस्या ही नहीं है अपितु सेडीमेंट नियंत्रण की भी समस्या है । उन्होंने ‘आईसीओएलडी' का उल्लेख करते हुए कहा है कि आज अत्याधुनिक प्रौद्योगिकी यह है कि ‘अधिक पानी को बहाने, जलाशय को खाली करने, सेडीमेंट निकालने और अंतर्ग्रहण छिद्रों में सेडीमेंट के प्रवेश को रोकने के लिए तल निकास द्वार का उपयोग किया जाए ।'

79. Pakistan contended, inter alia, that conditions at the Baglihar site did not require a gated spillway; that the spillway gates were not at the highest level; Indian calculations of the design flood and the height of the dam (Freeboard) were excessive; India's calculation of the required Pondage of 37.5 MCM was also too high as the correct Pondage should be 6.22 MCM; and that the level of intakes for the Power Plant were not at the highest level as required by the Treaty.

80. The determination upheld India's design flood value of 16,500 cumec against Pakistan's calculations of 14,900 cumec; upheld India's design of gated spillways; provided for freeboard of 3 metres as against 4.5 metres designed by India and 0.84 m calculated by Pakistan; provided for a maximum pondage of 32.56 million cubic metres (MCM) as against 37.5 MCM calculated by India and 6.22 MCM calculated by Pakistan; fixed the intake level 3 metres higher than as designed by India; and provided for India to resort to drawing down of reservoir for its maintenance and sustainability during monsoon season each year.
