1. (h) wilfully contravenes section 348 (failure to charge lowest rate for broadcasting time or advertising space);

2. The condemnation in the strategy of terrorism in all its forms and manifestations signals the international community’s will to no longer tolerate the actions of the sponsors and abettors of terrorism or of those who wilfully fail to prevent terrorists from utilizing their territories.

La condamnation dans la Stratégie du terrorisme sous toutes ses formes et dans toutes ses manifestations indique la volonté de la communauté internationale de ne plus tolérer davantage les actes des commanditaires et des complices du terrorisme ou de ceux qui omettent délibérément d’empêcher les terroristes d’utiliser leurs territoires.

3. If the owner or his agent, or the occupant of the land, refuses or declines to appoint an arbitrator, or when for any reason no arbitrator is so appointed in the time limited therefor in the notice provided for by this section, the mining recorder for the district in which the land in question is situated shall forthwith, on being satisfied by affidavit that such notice has come to the knowledge of such owner, agent or occupant, or that such owner, agent or occupant, wilfully evades the service of such notice, or cannot be found, and that reasonable efforts have been made to effect such service, and that the notice was left at the last place of abode of such owner, agent or occupant, as above provided, appoint an arbitrator on his behalf.

Si le propriétaire ou son mandataire, ou l’occupant, refuse de nommer un arbitre ou si, pour quelque raison que ce soit, aucun arbitre n’est nommé dans le délai indiqué dans l’avis prévu par le présent article, le registraire minier du district dans lequel est située la terre en question doit sans délai, lorsqu’il est convaincu par un affidavit que cet avis a été porté à la connaissance du propriétaire, du mandataire ou de l’occupant, que celui-ci se soustrait sciemment à la signification de l’avis ou, qu’il est impossible de le trouver, que des efforts raisonnables ont été déployés pour réaliser cette signification et que l’avis a été laissé à sa dernière résidence connue, tel qu’il est mentionné ci-dessus, nommer un arbitre en son nom.
