1. For purposes of deciding whether or not to detain a person pending removal, the impossibility to reach the person concerned could lead to a presumption that he/she has absconded and therefore should be held to ensure effective removal from the territory, only where the addressee of the removal order has been duly informed that he/she was under an obligation to inform the authorities about any change of residence.

Pour décider s’il convient ou non de placer une personne en détention préalablement à son éloignement, l’impossibilité de joindre l’intéressé peut conduire à présumer qu’il s’est soustrait à la justice et qu’il devrait donc être placé en détention pour garantir son éloignement effectif du territoire, uniquement si l’intéressé a été dûment informé qu’il se trouvait dans l’obligation de notifier aux autorités tout changement d’adresse.
