1. There is no dispute that the claimant was in receipt of a pension, and there have been numerous decisions of Umpires which have held that pensions are allocatable as earnings, pursuant to these provisions.

2. Umpires are abjured, as are Courts, by a volume of jurisprudence, not to go blithely identifying and proliferating new grounds of public policy, but it must be noted that the claimant's effort to acquire sufficient skills in the "other" one of Canada's official languages (here, French), certainly comes into sweet accord with a long standing national public policy: to help Canadians, with their constitutionally guaranteed right of mobility, to become proficient in both official languages where social and economic circumstances warrant such proficiency.

Une ample jurisprudence invite les juges-arbitres, de même que les cours, à s'abstenir de cerner allègrement de nouveaux motifs d'intérêt public, mais il faut souligner que l'effort que faisait la prestataire pour acquérir des compétences suffisantes dans «l'autre» langue officielle du Canada (en l'occurrence, le français) s'harmonise certainement avec la politique nationale d'intérêt public de longue date : aider les Canadiens, grâce à la liberté de circulation que leur garantit la constitution, à devenir compétents dans les deux langues officielles lorsque les circonstances sociales et économiques le justifient.
