The aim of the present Decision is to establish whether the services offered by Poste are exposed to such a level of competition (on markets to which access is free) that this will ensure that, also in the absence of the discipline brought about by the detailed procurement rules set out in Directive 2004/17/EC, Poste’s procurement for the pursuit of the activities concerned here will be carried out in a transparent, non-discriminatory manner based on criteria allowing it to identify the solution which overall is the economically most advantageous one.

La présente décision vise à établir si les services offerts par Poste Italiane sont soumis à un niveau de concurrence (sur les marchés dont l’accès est libre) susceptible de garantir que, même en l’absence de la discipline qu’imposent les règles détaillées de passation des marchés fixées par la directive 2004/17/CE, Poste Italiane s’appuiera sur des procédures de passation de marchés transparentes et non discriminatoires pour les activités concernées dans le présent cas et sur des critères lui permettant de retenir la solution globalement la plus avantageuse sur le plan économique.
