The norms of the Part 7 of the new Criminal Code and particularly Article 38 also establish criminal liability for the accessories to a crime: an organizer (a person who organized or led the perpetration of felony as well as established or led a gang or criminal association), an instigator (a person who incited another person to perpetrate a felony by persuasion, financial incentive, threat or otherwise) and an abettor (a person who assisted by advice, instruction, offering an information, resources or tools, eliminating obstacles, had previously promised to conceal the offender, means or tools, traces of felony, to conceal, purchase or vend the items obtained through felony).

Les normes édictées dans le titre 7 du nouveau Code pénal, et particulièrement à l’article 38, engagent également la responsabilité pénale en cas de complicité : elles visent l’organisation (personnes ayant organisé ou dirigé la commission d’un délit, ou créé ou dirigé une association de malfaiteurs), l’incitation (personnes ayant incité autrui, par la persuasion, l’offre de motivations financières, la menace ou autre, à perpétrer une infraction), la complicité avant ou après la commission de l’infraction (personnes ayant aidé par des conseils, des instructions, des informations, des ressources ou des instruments, ayant éliminé des obstacles, ayant promis à l’avance de cacher le coupable, ses moyens, ses instruments, de cacher, d’acheter ou de vendre des objets obtenus par une infraction).
