However, in the contested decision, the Commission interpreted ABB’s statements not only as referring to the entire period of infringement since 1988, even though neither TM T&D nor JAEPS existed at that time, but also as involving, in addition to those two companies, Hitachi and Hitachi Europe.

3. 114 Moreover, the Commission finds that the evidence adduced by Sumitomo Electric Industries, Hitachi Cable and J‐Power Systems in the context of their joint application for immunity on which the Commission relied to demonstrate the existence of the cartel before 13 November 2000 was corroborated by ABB’s oral statements in the context of its application for immunity and by the contemporaneous documents that ABB submitted in the context of that application.

114 La Commission constate en outre que les preuves fournies dans le cadre de leur demande conjointe d’immunité par Sumitomo Electric Industries, Hitachi Cable et J‐Power Systems, sur lesquelles elle s’est fondée pour démontrer l’existence de l’entente avant le 13 novembre 2000, étaient corroborées par les déclarations orales d’ABB dans le cadre de la demande d’immunité de cette dernière ainsi que par les documents contemporains produits par celle-ci dans le cadre de cette demande.
