Friz (C‐215/08, EU:C:2010:186) is expressly limited to a consumer’s membership of a closed-end real property fund established in the form of a partnership, as is noted in paragraph 24 of that judgment, and therefore does not relate generally to all aleatory contracts, that is to say, contracts based on chance or risk.
