16. 26 The General Court was wrong in finding, in paragraph 69 of the judgment under appeal, that Ballast Nedam could not have been unaware that it was likely to be the addressee of a final Commission decision in its capacity as BNGW’s parent company, when it is apparent from the General Court’s own findings that, in point 342 of the statement of objections, the Commission had not indicated that the statement of objections was addressed to Ballast Nedam on the ground that it exercised decisive influence over BNGW’s commercial conduct, and the General Court acknowledged that the statement of objections was unclear in that regard.

26 Das Gericht ist nämlich in Rn. 69 des angefochtenen Urteils unzutreffend davon ausgegangen, dass es der Rechtsmittelführerin nicht verborgen bleiben konnte, dass sie in ihrer Eigenschaft als Muttergesellschaft von BNGW möglicherweise Adressatin einer abschließenden Entscheidung der Kommission werden würde, obwohl aus den vom Gericht selbst getroffenen Feststellungen hervorgeht, dass die Kommission in Rn. 342 der Mitteilung der Beschwerdepunkte nicht angegeben hat, dass diese Mitteilung an die Rechtsmittelführerin gerichtet sei, weil sie einen bestimmenden Einfluss auf das geschäftliche Verhalten von BNGW ausübe, und obwohl das Gericht einräumt, dass die Mitteilung der Beschwerdepunkte insoweit nicht klar sei.
