(225) The doubts prompting the Commission to initiate the procedure have been allayed as far as the commitments (b) and (f) of Article 1 of the 1994 decision (Article 1(a) of the 1998 decision) are concerned, as well as concerning the granting of EUR 19,5 million loan, the compensation for the early eviction from Hellinikon to Spata, the debt of EUR 2,43 million towards Olympic Catering, the operation of the fuelling facilities and the payment of VAT at 8 % collected by OA on domestic fares.

29. 291 As a preliminary point, it is appropriate to observe that, contrary to what the Commission’s experts’ conclusions set out in the contested decision (point 124) seem to suggest, the fact that Article 27 of Law No 3185/2003 provided for early payment of the compensation in question, up to a sum equivalent to the nominal value of NOA’s shares, does not permit it to be assumed that the inputs of capital, constituted by the transfer of the assets of the Olympic Airways Group’s flight operations sector, were overvalued, with a view to supporting OA, in great financial difficulties, during its conversion and winding-up.

291 Anders als die in der angefochtenen Entscheidung (124. Erwägungsgrund) aufgeführten Schlussfolgerungen der Gutachter der Kommission nahezulegen scheinen, kann aufgrund des Umstands, dass Art. 27 des Gesetzes Nr. 3185/2003 die Vorauszahlung der streitigen Entschädigung bis zur Höhe des dem Nominalwert der Aktien von NOA entsprechenden Betrags vorsah, nicht angenommen werden, dass die Gesellschaftskapitaleinlagen, bestehend aus der Übertragung der Aktiva der Flugbetriebssparte der Olympic Airways Group, überbewertet wurden, um OA, die sich in großen finanziellen Schwierigkeiten befand, im Umwandlungs- und Liquidationsverfahren zu unterstützen.
