1. The basic oxygen or LD-AC process has in fact been replaced by an electric arc production process.

2. The contested aid was intended for the replacement of the steel furnace - which was originally of the LD-AC oxygen-based design - by an electric arc furnace.

3. Whether the construction of a new electric arc furnace at Esch-Schifflange to replace the old LD-AC furnace is to be regarded as an adaptation of old plant to meet the new standards or the construction of new plant

Zur Frage, ob die Errichtung eines neuen Elektroofens in Esch-Schifflange, um den alten LD-AC-Ofen zu ersetzen, als eine Anpassung der alten Anlagen an die neuen Normen oder als Errichtung einer neuen Anlage anzusehen ist

4. The replacement of the old LD-AC furnace by the new electric arc furnace, which is the essential element of the new production process, cannot be regarded as an adaptation of an existing production process but must be regarded as the replacement of one process by another.

Die Ersetzung des alten LD-AC-Stahlwerks durch das neue Elektrostahlwerk, die den wichtigsten Bestandteil des neuen Produktionsverfahrens darstelle, könne nicht als Anpassung eines vorhandenen Produktionsverfahrens, sondern nur als eine Ersetzung dieses Verfahrens angesehen werden.

5. 83 Arbed therefore submits that, even if the replacement of the LD-AC steel converters by electric arc furnaces is regarded as the replacement rather than the adaptation of existing plant, the Commission correctly applied the Fifth Code when it considered that such replacement was covered by Article 3(1).

83 Selbst wenn man die Ersetzung der LD-AC-Konverter durch Elektroöfen als Ersetzung einer bestehenden Anlage und nicht als eine Anpassung dieser Anlage ansehe, habe die Kommission daher den Fünften Kodex richtig angewendet, als sie angenommen habe, daß eine solche Ersetzung durch Artikel 3 Absatz 1 dieses Kodex erfasst werde.

6. 42 In the light of the arguments put forward by the parties, the question whether the construction of a new electric arc furnace at Esch-Schifflange to replace the old LD-AC furnace is to be regarded as an adaptation of old plant to meet the new standards or the construction of new plant must be considered separately as a preliminary issue.

42 In Anbetracht der einzelnen von den Beteiligten vorgebrachten Argumente ist getrennt und vorab die Frage zu prüfen, ob die Errichtung eines neuen Elektroofens in Esch-Schifflange zum Ersatz des alten LD-AC-Ofens als eine Anpassung der alten Anlagen an die neuen Normen oder als Errichtung einer neuen Anlage anzusehen ist.
