1. 68 With regard to the details of such a solution, it should be noted that there are only two circumstances in which the service of a judicial document between Member States falls outside the scope of Regulation No 1393/2007: first, where the permanent or habitual residence of the addressee is unknown and, secondly, where that person has appointed an authorised representative in the Member State where the judicial proceedings are taking place (see judgment in Alder, C‐325/11, EU:C:2012:824, paragraph 24).

68 Was die Modalitäten einer solchen Lösung anbelangt, ist darauf hinzuweisen, dass es nur zwei Umstände gibt, unter denen die Zustellung eines gerichtlichen Schriftstücks von einem Mitgliedstaat in einen anderen dem Anwendungsbereich der Verordnung Nr. 1393/2007 entzogen ist, was zum einen der Fall ist, wenn der Wohnsitz oder gewöhnliche Aufenthalt des Empfängers unbekannt ist, und zum anderen, wenn dieser einen Bevollmächtigten in dem Mitgliedstaat benannt hat, in dem das Gerichtsverfahren stattfindet (vgl. Urteil Alder, C‐325/11, EU:C:2012:824, Rn. 24).
