1. As I have already mentioned, it would be glaringly inconsistent with the purpose of appeal proceedings if the Court of Justice were now to revisit all the evidence adduced and substitute its assessment of that evidence for the assessment made by the General Court.

Wie schon erwähnt, widerspräche es eklatant dem Sinn eines Rechtsmittelverfahrens, wenn der Gerichtshof nun das gesamte Beweismaterial erneut sichten und dessen Bewertung seitens des Gerichts durch seine eigene ersetzen würde.
