1. 17 The Admiralty Court accepted that Folio 2006 and Folio 2007 and the proceedings commenced in the Netherlands were related actions.

18 Der Admiralty Court räumte ein, Folio 2006 und Folio 2007 einerseits und das in den Niederlanden anhängig gemachte Verfahren andererseits ständen miteinander im Zusammenhang.

2. 11 Group 2 (Phibro) also commenced an action in rem before the same court (hereinafter "Folio 2007") against the ship Maciej Rataj.

12 Die Gruppe 2 (Phibro) erhob bei dem gleichen Gericht des Vereinigten Königreichs eine dingliche Klage (nachstehend: Folio 2007) gegen das Schiff Maciej Rataj.

3. As regards Folio 2007, since they accepted that the Admiralty Court was the first seised, they did not rely on Article 21 of the Convention but none the less requested that the Admiralty Court decline jurisdiction on the basis of Article 22.

Im Rahmen von Folio 2007 räumten sie ein, der Admiralty Court sei zuerst angerufen worden, und beriefen sich nicht auf Artikel 21 des Übereinkommens, beantragten jedoch, der Admiralty Court solle sich gemäß Artikel 22 für unzuständig erklären.

4. 15 As regards Folio 2006, the shipowners moved the Admiralty Court to decline jurisdiction in favour of the Netherlands court pursuant to Article 21 of the Brussels Convention relating to lis pendens or, in the alternative, pursuant to Article 22 on related actions.

16 Im Rahmen von Folio 2006 beantragten die Schiffseigner beim Admiralty Court, sich gemäß dem die Rechtshängigkeit betreffenden Artikel 21 des Übereinkommens oder hilfsweise gemäß Artikel 22, der im Zusammenhang stehende Verfahren betrifft, zugunsten des niederländischen Gerichts für unzuständig zu erklären.
