1. Notwithstanding the provisions of Articles 5.1 and 14.1, if the parties expressly so authorize the tribunal in the course of the arbitration proceedings, it shall decide as amicable compositor or ex aequo et bono.

Ungeachtet der Bestimmungen des Artikels 5 Absatz 1 und des Artikels 14 Absatz 1 hat das Gericht nur dann als gütlicher Vermittler oder ex æquo et bono zu entscheiden, wenn es dazu ausdrücklich von den Parteien ermächtigt wurde.
