1. That refusal adversely affected the complainants’ remuneration, grade and/or promotion prospects.

2. Right from the outset the overwhelming majority of complainants have refrained from taking up the offer of analogue local loops.

Die überwiegende Anzahl der Beschwerdeführer hat dagegen von Anfang an auf das Angebot analoger Teilnehmeranschlüsse verzichtet.

Als Alternative hätte Hilti wegen dieser Werbung oder Falschdarstellung privat prozessieren können, oder sie hätte die Advertising Standards Authority anrufen können, wenn sie der Ansicht war, daß die Beschwerdeführer den Code of Advertising Practice verletzen.

6. (2) The Commission officially so advised the exporter and importer known to be concerned, the representatives of the exporting country and the complainants, and gave the parties directly concerned the opportunity to make known their views in writing and to request a hearing.

7. However, in rejecting the requests submitted to it, the Commission also relied on the fact that a finding that the Community competition rules had been infringed, assuming that it were made out, could not, in the circumstances of the case, alter the complainants' situation.

Die Kommission hat sich bei der Zurückweisung der ihr vorgelegten Anträge allerdings auch darauf gestützt, daß die Feststellung eines Verstosses gegen die gemeinschaftlichen Wettbewerbsregeln, selbst wenn er vorliegen sollte, unter den Umständen des vorliegenden Falles doch nicht geeignet wäre, die Lage der Beschwerdeführer zu ändern.

In so far as the jurisdiction of the Irish labour courts is regarded as compulsory in respect of the period from 14 July 2003, the fact that employees such as the complainants are in a worse position is apparent also from the fact that – as already mentioned in another context (38) – they would in practice be forced to pursue two parallel sets of proceedings in order to obtain the protection to which they are entitled under Community law: the first before the ordinary courts in respect of the period prior to the transposition of Directive 1999/70, and the second before the labour courts in respect of the period afterwards.

Sofern man die Zuständigkeit der irischen Arbeitsgerichtsbarkeit für die Zeit ab dem 14. Juli 2003 als obligatorisch ansieht, kann eine Schlechterstellung von Arbeitnehmern wie den Beschwerdeführern auch darin gesehen werden, dass sie – wie bereits in anderem Zusammenhang erwähnt(38) – faktisch gezwungen wären, zwei parallele Verfahren anzustrengen, um den ihnen kraft Gemeinschaftsrechts zustehenden Schutz zu erlangen: ein erstes vor den ordentlichen Gerichten für die Zeit bis zur Umsetzung der Richtlinie 1999/70 und ein zweites vor der Arbeitsgerichtsbarkeit für die Zeit danach.
