1. 15 With regard to the third complaint, the French Republic maintains that the circumstance alleged by the Commission was ascribable to uncertainty as to the precise implications of Vanbraekel and Others, which was to be discussed by the Member States in the Council of the European Union.

15 Zur dritten Rüge machte die Französische Republik geltend, dass der von der Kommission angeführte Umstand auf die Unsicherheit in Bezug auf die exakte Tragweite des Urteils Vanbraekel u. a. zurückzuführen sei, die zwischen den Mitgliedstaaten auf der Ebene des Rates der Europäischen Union debattiert werden müsse.
