3. The Portuguese Government further maintains that ANA-EP is excluded from the scope of the directive, since, as a body which administers transport services, it is covered by the exception contained in Article 2(2) of the directive.

Die portugiesische Regierung vertritt ausserdem die Ansicht, das Unternehmen ANA-EP sei vom Anwendungsbereich der Richtlinie 77/62 ausgenommen, da sie als Verkehrsträger unter die Ausnahmebestimmung des Artikels 2 Absatz 2 der Richtlinie falle.
