Auf Grund dieser klinischen Erfahrungen lassen sich folgende Aussagen machen: Bei erfolglose konservativer Behandlung soll die Operation nach Möglichkeit in den ersten 8 Wochen nach dem Unfall erfolgen.-Die Abmeiβelung des Akromions birgt die Gefahr einer Exostosenbildung in sich und sollte nicht durchgeführt werden. — Bei engem subakromialen Raum soll das Ligamentum coracoacromiale durchtrennt werden. — Der postoperativen Behandlung muβ groβe Sorgfalt gewidmet werden.

The following statements based on our experiences are possible: If conservative treatment is without result, operation should be done within 8 weeks after the accident —Because of the danger of exostoses at the point of the osteotomy of the acromion which includes the restriction of movement, the transacromial approach is not advisable. — If there is only a small space between the acromion and the humeral head resection of the coracoacromial ligament is an advisable method for better admittance to the shoulder joint. — A sufficient treatment in the postoperative phase is of great importance for a good functional result.

8. 47 Das Gericht hat in Randnr. 19 des angefochtenen Beschlusses zu Recht dargelegt, dass bei Klagefristen der Begriff des entschuldbaren Irrtums eng auszulegen sei und sich nur auf Ausnahmefälle beziehen könne, insbesondere auf solche, in denen das betroffene Gemeinschaftsorgan ein Verhalten an den Tag gelegt habe, das für sich genommen oder aber in ausschlaggebendem Maß geeignet gewesen sei, bei einem gutgläubigen Rechtsbürger, der alle Sorgfalt aufwende, die von einem Wirtschaftsteilnehmer mit normalem Kenntnisstand zu verlangen sei, eine verständliche Verwirrung hervorzurufen.

47 The General Court was fully entitled to state, at paragraph 19 of the order under appeal, that, concerning time-limits for bringing proceedings, the concept of excusable error must be strictly construed and can concern only exceptional circumstances in which, in particular, the conduct of the institution concerned has been, either alone or to a decisive extent, such as to give rise to a pardonable confusion in the mind of a party acting in good faith and exercising all the diligence required of a normally experienced trader.
